Introduction

Baijinxiu is the live and amusement platform based on the data network provided to you by Beijing Wali Network Technology Co., Ltd and its associated companies ("Wali" or "we"). You can use this application to realize real-time live, short video recording & uploading, rewarding with gifts and other amusement and social intercourse functions.

We are committed to protecting your privacy. This Privacy Policy sets out the principles on which Baijinxiu operates, and constitutes an important part of Xiaomi Privacy Policy. In the event of inconsistency between this Privacy Policy and Xiaomi Privacy Policy with respect to Baijinxiu, the former shall prevail. For the terms and conditions not stipulated in this Privacy Policy, Xiaomi Privacy Policy shall prevail. Terms and conditions regarding the protection of minors, security measures, and cross-border data transmission can be found in Xiaomi Privacy Policy.

This Privacy Policy is designed with your needs in mind, and you must have a comprehensive understanding of our personal information collection and usage practices while ensuring that ultimately, you have control of your personal information provided to us. This Privacy Policy explains how we collect, use, disclose, process and store any information that you give us when you use Baijinxiu. Under this Privacy Policy, "personal information" means information that can be used to directly or indirectly identify an individual, either from that information alone or from that information combined with other information about that individual available to Xiaomi. 1. What information is collected by us and how do we use it?

1.1 Personal information that we collect and use with your authorization

The purpose of collecting personal information is to provide you with products and/or services and to ensure that we comply with applicable laws, regulations and other regulatory requirements.You have the right to choose whether or not to provide the information we have requested, but in most cases, if you do not provide your personal information, we may not be able to provide you with our services or respond to your queries. These functions include:

1.1.1 Account registration and sign-in

(1) When you create a Baijinxiu account with your mobile phone number to use the basic services provided by Baijinxiu to you and in order to complete the registration, you need to provide complete mobile phone number with which you can receive SMS or phone call. We will confirm whether your identification is valid by sending SMS verification code. Once you have passed the verification and read and agreed this policy and user agreement, the account registration is completed.

(2) You can log in via your Mi account or other third-party platform, such as WeChat, QQ, Weibo and YY, and connect such account to your product account.If you don’t agree to authorized or refuse us to obtain the information above, you will not be able to log in the product via the third-party account, however, your normal using of other functions of this product will not be affected.

(3) In order to create more personalized figure, you can add other information to your account, such as nickname, sex and personalized signature, etc.Take it easy that if you refuse to provide other information above, your using basic functions of Baijinxiu will not be affected.

1.1.2 The functions of playing and browsing

(1) We might collect your device identifier (IMEI/OAID, MAC address, Android ID), device type, network type, system setting, information of application version as well as information of live room so as to provide you with the optimum way for search results.

(2) When you are searching the live you are interested in with the search function, we might collect your search keywords so as to make you convenient in repetitive input or display the content which is associated with your search content.Please note that the information of your search keywords can’t identify you individually, and it doesn’t belong to your individual information; we have the right to use it in any purposes; only when the information of your search keywords can identify you when it is used along with other information, we will regard in the information of your research keywords as your individual information during they are used together, and it will be processed and protected along with the your historical records on searching according to this privacy policy.

(3) When you are using relevant neighboring functions, we will request you to grant permission on location, and collect the positioning information relating to this function so that it will be convenient for use to present the live content of neighboring users to you based on the geological location.If you don’t agree or refuse to grand permission, you will not be able to use this functions, however, your normal use of the other functions of the product will not be affected.

1.1.3 The functions of releasing and interaction

(1) When you are using short video releasing, radio or other functions or services which call for identity authentication, you should provide real name and ID card number to complete the real name authentication according to relevant laws and regulations of the People’s Republic of China. You will not be able to use the corresponding functions if you don’t provide the information above or the information is not real.

(2) When you are opening a live account, you need to provide the real identity information needed for identity identification service according to relevant laws and regulations. Such information include name, mobile phone number, ID card number, facial feature information, etc; if you can’t complete the identity authentication by the way of face recognition provided by the third-party authentication institute, you should provide us with your name, ID card number, mobile phone number, photos of front and back sides of ID card as well as the photo of you taking the front side of your ID card in your hand so as to complete the identity authentication by manual verification; the aforesaid information belongs to the sensitive personal information, with your explicit consent, we will use encryption technology to collect, transfer and store the information and it is only used for real time authentication as well as the usage regulated by laws and regulations; we will not use it for other purposes without your explicit authorization and consent.

(3) When you are releasing live or short video, you should open the authorities for camera, reading/writing storage and microphone to warrant the normal use of functions. We will collect your live cover and title for presentation, as well as your device model to find and resolve the cause for online abnormality. When you are using the function of releasing radio, you should open the authority of microphone. We will collect your device model and voice content for this propose. When you are using the function of news releasing provided by Baijinxiu, we will collect the images and content you have released for presentation. When you are using the functions above, you can also select to open the authority of position and we will collect your geological position information to display the position, or forward the content you have released to other people based on our geological position information.

(4) You can focus on the anchors you love so as to receive the content they release, or you can like, release your comments or share in other platforms for them. We will collect your private message, likes, comments and share records for presentation. Your private message, likes, comments or share records will be associated with your accounts.

(5) You can deliver the private message to the friends you have added or the anchors who have agreed to receive private messages from strangers. If you select to open the authority of microphone, you can also deliver voice private messages. Take it easy that rejecting voice authority will not affect your use of basic functions on private messages.

1.1.4 Recharging/awarding function

(1) You can recharge your account when you are watching live in Baijinxiu. We will collect your records on recharging and consumption so that it will be convenient for you to inquire your transaction records. When you are awarding for the live you are interested in, we might also collect your account information, the number of live room where you are as well as the order information for normal fee reduction. At the same time, we will also collect your icon, nickname and awarding data (order number, user ID, gift ID, gift value, order status and awarding time) and present them to other users.

(2) In order to make Baijinxiu more interesting, you can also make an appointment with the anchor you are interested in, and we might collect the accounting applying for appointment as well as the device model, account of appointed anchor, the uploaded video for preview as well as order information.

The payment function itself doesn’t collect your personal information, however, we need to share your order information with such payment institutes so as to confirm your payment directive and complete the payment.

1.1.5 The function of beautifying/filter

When you are using the beautifying/filter function in Baijinxiu, we might collect the information of your facial figure so as to provide better visual effects. Take it easy that the information of your facial figure will only be processed in your client, and we will not send back, store or share any of your information on facial figure.

1.1.6 User feedback

If you meet any problems in using, you can submit your opinions and feedback by clicking “Contact with customer service” in the device. We will collect your user log (such as turning on/off the live by the user) so as to resolve the problems for you better.

1.1.7 Score exchanging

You can use your score and other virtual properties to exchange for corresponding gifts; and when you exchange for material gifts, you should provide your name, contact method and contact address and other information, so as to provide award mailing and other services to you.

1.2 Personal information you may choose whether to authorize us to collect and use

To improve your experience in using Baijinxiu, we may collect and use your personal information for our additional functions below. If you do not provide such personal information, you may use Baijinxiu still, but may not have access to such additional functions which bring convenience and amusement to you. The additional features include:

1.2.1 The additional function based on position authority: when you have opened this authority and used the position of live display or news releasing provided on the basis of position, as well as the recommended live contact provided for you based on geological position, we will collect your position information (we only collect the geological position where you were at that time, and we will not determine your whereabouts and traces with the position information of different time periods) to determine your position.

1.2.2 The additional function based on the authority of camera, you can take photos, audios or videos after opening this authority for live, and use the face recognition and other functions under specific scenarios (with your authorization).

1.2.3 The additional function based on the authority of reading and writing external storage: after opening this authority, you can use relevant functions to set your icon, comment or share or download/store/store in catch/alter/delete the special effect of gift, image, document and other information.

1.2.4 The additional function based on the authority of microphone: you can use microphone to record audio, release audio and video and make broadcast after opening this authority.

Please note that if you open the authority above, it means that you have authorized us to collect and use the information above to realize the functions above; if you close the authority, it means that you have cancelled these authorizations, and we will not collect and use your personal information continually, and we can't provide the aforesaid functions being corresponding to these authorizations. Your decision of closing authority will not affect the processing of the personal information based on your authorization previously.

1.3 The exceptional situations on obtaining your authorization and consent

1.3.1 You are fully informed, according to the laws, regulations and relevant national standard, that we may collect and use personal information without your consent if:

1.3.1.1 The personal information is vital to national security and defense;

1.3.1.2 The personal information is vital to public safety, public health, and major public interests;

1.3.1.3 The personal information is related to criminal investigations, prosecutions, trials, or execution of judgments;

1.3.1.8 The personal information is necessary to maintain the safe and steady operation of products and/or services provided, such as for discovering and handling faults of products and/or services;

1.3.1.9 The personal information is required for legal news releases; and

1.3.1.10 The personal information is de-identified in the results of statistical or academic research based on public interest.

1.4 Collection of the personal information from third-party sources

When permitted by law, we will collect information about you from third-party sources. For example:

1.4.1 You have authorized the account of the third-party to login and use our service or import your information in the third-party platform (including WeChat, YY, QQ, and Weibo). If you are the appointed anchor, the relevant information will be collected via the function of appointment.

1.4.2 When you are using the function of authentication via Weibo provided by the product, we will cite your Weibo authentication information after authorization and obtain the icon of third-party authentication; we will use the industrially common way and largest commercial effort to protect the security of your personal sensitive information. If you don’t provide such information, you might not to obtain the relevant services, however, your normal use of other functions will not be affected.

1.5 Non-personally identifiable information

We may also collect other types of information which are not directly or indirectly linked to an individual and which may not be defined as personal information. Such information may include statistical data generated when you use a specific service (e.g. non-identifiable device information, daily usage events, page views, time on page, and session events), network monitoring data (e.g. request time, number of request or error request etc.), and app crashes. The purpose of such collection is to improve the services we provide to you. The type and amount of information collected depends on how you use our products and/or services. For the purpose of this Privacy Policy, such aggregated data is not personal information as it cannot be used to identify you. However, if we combine non-personal information with personal information, such information will be treated as personal information.

2. Cookies and other technologies

Technologies such as cookies, tags, and scripts are used by Xiaomi and our third party service providers and business partners (for more information see "How we share, transfer, and publicly disclose your personal information" below). Such technologies are used to analyze trends, manage websites, trace your website activities and collect the statistics information on the entire user group. We will receive the individual or aggregated analysis reports collected via the technologies above. Such technologies can help us better understand your behaviors, and make us recognize which part of our website you have browsed, as well as measure the effects of advertisements and network search for improvement. We regard the information collected via Cookie and other technologies as non-personal information. However, if the local laws identify the IP address or similar tags as personal information, we will identify such tags as personal information either.

  • Log files: As true of most websites, we gather certain information and store it in log files. We do not link this automatically collected data to other information we gather about you.
  • Mobile analytics: Within some of our mobile applications we use mobile analytics software to allow us to better understand the functionality of our mobile software on your phone. This software may record information such as how often you use the application, the events that occur within the application, aggregated usage, performance data, and where crashes occur within the application. We do not link the information we store within the analytics software to any personal information you submit within the mobile application.

Part of the services in Baijinxiu is provided by third parties. We may share your personal information on occasion to third parties (as described below) in order to provide the products or services that you have requested.

(1) Positioning service provider: The positioning service in this business is provided by the third party (including Baidu), and we might use SDK or relevant technologies to provide your GPS information to such service providers for providing accurate positioning services to you.

(2) Payment service provider: The payment service in this business is provided by the third party, including Alipay, WeChat and UnionPay. We will provide your order number and other such information to such service provider to provide the payment services to you.

(3) Content service provider: The content service in this business is provided by the third party including YY Live, and we might provide your statistical data, account number, nick name, sex and icon when you are watching live to such service provider so as to provide the corresponding live content to you, and it will be convenient for the payment and settlement between us and service provider. The statistical data generated during you watching live will be provided to such service providers. Take it easy that such kind of statistical data will not be corresponded to specific individuals, therefore, it doesn’t belong to individual information.

(4) Real name authentication service provider: The real name authentication service in this business (include face recognition) is provided by the third parties, including the database of basic identification information of customer or system service provider, face information identification service provider.

If we share your personal information with such third parties, we will guarantee the security of your information with encryption and other measures. For the companies and organizations with which we share the personal information, we will perform rational examination to the environment on data security and sign the strictest data processing agreement with them, we will require the third party to take sufficient protection measures to your information and to abide by the requirements in relevant laws and regulations strictly.

In addition to releasing the winner's mobile phone number or Mi Account ID or user name when publishing the winner list in de-identifiable form, Xiaomi will only publicly disclose your personal information under the following circumstances:

4. How we store and protect your personal information

4.1 Security safeguards

We are committed to keeping your personal information secure. In order to prevent unauthorized access, disclosure or other similar risks, we have put in place all legally required physical, electronic and managerial procedures to safeguard and secure the information we collect on your mobile device and on Xiaomi websites. We will ensure that we safeguard your personal information in accordance with applicable law.

All your personal information is stored on secure servers, and protected in controlled facilities. We classify your information based on importance and sensitivity, and ensure that your personal information has the required level of security. We have special access controls for cloud-based data storage, and we regularly review our information collection, storage and processing practices, including physical security measures, to guard against any unauthorized access and use.

We will perform responsible investigation to the third-party service provider and business partners so as to warrant that they are capable to protect your personal information.We will also adopt appropriate contractual restrictions and conduct audits and evaluations when necessary, to check that whether third parties have adopted appropriate security standards.In addition, our employees and those of our business partners and third party service providers who access your personal information are subject to enforceable contractual obligations of confidentiality.

We conduct security and privacy protection training courses and tests to enhance our employees' awareness of the importance of protecting personal information. We will take all practicable and legally required steps to safeguard your personal information. However, you should be aware that the use of the Internet is not entirely secure, and for this reason we cannot guarantee the security or integrity of any personal information when transferred from you or to you via the Internet.

4.2 What you can do

You can set a unique password for Xiaomi by not disclosing your login password or account information to anybody (unless such person is duly authorized by you) to avoid password leaks to other websites which may harm your account security at Xiaomi. Whenever possible, please do not disclose the verification code you received to anyone (including those who claim to be Xiaomi customer service). Whenever you sign in as a Mi Account user on Xiaomi websites, particularly on somebody else's computer or on public Internet terminals, you should always sign out at the end of your session.

Xiaomi cannot be held responsible for lapses in security caused by third party accessing your personal information as a result of your failure to keep your personal information private. Notwithstanding the foregoing, you must notify us immediately if there is any unauthorized use of your account by any other Internet user or any other breach of security.

Your assistance will help us protect the privacy of your personal information.

4.3 The policies on data storage and preservation

We will require to preserve the personal information based on the period which is necessary for information collected stated in this privacy polity, or by abiding the relevant and available legal requirements. We will cease to retain and delete or anonymize personal information once the purpose of collection is fulfilled, or after we confirm your request for erasure, or after we terminate the operation of the corresponding product or service. 5.4 Canceling a service or account

If you want to cancel concrete products or services, you can realize by the following ways:

  • Open app and tap "My" – "Settings" – "Account and security" – "Delete account" to complete account cancelling or services. In order to protect your rights and benefits, please read the prompts and instruction in the page of cancelling accounts carefully to complete the cancel. We will respond to your request of cancelling within the time period prompted in the page (normally no longer than 15 days regulated by law).
  • If you wish to cancel your account, such operation will make you unable to use our products and services, and you should do prudently. We will decide whether to support your request of cancelling in consideration of your using to the products and services in order to protect the your and other people's legal rights and benefits.

6. Protection of minors

  • We consider it the responsibility of the parent or guardian to supervise the child's use of our products or services. However, we do not offer services directly to a child or use personal data of children for the purposes of marketing.
  • We will not receive or try to receive any personal information from minors.
