Mi Music is a platform provided by Xiaomi and its affiliated companies (hereinafter refer to as "Xiaomi", "we", "our" or "us"). You can use this app to play the songs saved on your device and stream online content.

We are committed to protecting your privacy. This Privacy Policy sets out the principles on which Mi Music operates, and constitutes an important part of Xiaomi Privacy Policy. In the event of inconsistency between this Privacy Policy and Xiaomi Privacy Policy with respect to Mi Music, the former shall prevail. For the terms and conditions not stipulated in this Privacy Policy, Xiaomi Privacy Policy shall prevail. This Privacy Policy is designed with your needs in mind, and it is important that you have a comprehensive understanding of our personal information collection and usage practices, while ensuring that ultimately, you have control of your personal information provided to us. This Privacy Policy explains how we collect, use, disclose, process and store any information that you give us when you use Mi Music. Under this Privacy Policy, "personal information" means information that can be used to directly or indirectly identify an individual, either from that information alone or from that information combined with other information about that individual available to us. We will use your personal information strictly following this Privacy Policy.

1. What information we collect and how we use it

1.1 Personal information that we collect and use with your authorization

The purpose of collecting personal information is to provide you with products and/or services, and to ensure that we comply with applicable laws, regulations, and other regulatory requirements. You have the right to choose whether or not to provide the information we have requested, but in most cases, if you do not provide your personal information, we may not be able to provide you with our products or services or respond to your queries. The related features include:

1.1.1 Features that are necessary for online music play

A. Music recommendations and search

To recommend music that might interest you, we may collect your information, like the identifier (IMEI/OAID/Android ID/SN) of the device through which you use our products and/or services, Xioami Account, app and system version numbers, and records of your music plays, downloads, favorites, and shares, in order to recommend suitable songs and playlists to you. We may also use the above information to continuously optimize our services.

You will also be able to search for the exact music you want. We store the keywords and phrases you've entered so that you can perform the same search without re-entering them. Please note that your search history cannot be used to identify you individually, and so is not considered part of your personal information. We therefore have the right to use it for any purpose. Only when your search history is used alongside other information and thus can be used to identify you will we regard your search history as personal information. Only then will it be processed and protected according to this Privacy Policy.

B. Playing and downloading music

When you tap on music to play it, we will collect the relevant information, including song ID, playlist ID, album ID, and artist ID, in order to play the corresponding song. We will also collect your music playback records and download records in order to display your playback and download history. We will also collect your network type to provide you with corresponding mobile data reminders to prevent excessive data use.

1.1.2 Online radio broadcast

When you access the radio section, we will collect your location information to recommend radio channels or anchors in your area. We also collect your broadcast history and station information so that you can view your broadcast history.

1.1.3 Playing online videos

When you access the video section and tap to play a video, we will collect the records and information of videos you have browsed and played in order to recommend video content that might interest you. We will also collect your network type to provide you with corresponding mobile data reminders to prevent excessive data use.

1.1.4 Service security

In order to ensure the security of your account and the stability of our services, we will collect your Xiaomi Account, IMEI/OAID/Android ID/SN, and IP address to identify any abnormal behavior associated with your account. We will also collect your MAC address to better regulate our ad services.

1.1.5 Other services

Some of our services are only available if you have third-party apps installed. For this reason, we only use the interface provided by the system to determine the installation status of Migu Music, Sing, and FM Radio, so that music can be stored locally, and so that we can provide you with FM radio, karaoke, and Migu Music library content services. Your app installation list and installation status will not be uploaded to the server.

1.1.6 Features based on device permissions

A. Features based on access to device info

When you use online or local playback, we will access your device information in order to determine your device's call status and pause or resume playback for you.

B. Features based on access to device storage

When you use Sync with the cloud and online or local playback, we'll access your device storage to access and save the album cover, lyrics, and your downloaded songs, videos, and other content.

C. Features based on access to accounts on your device

When you're signed in to your Xiaomi Account, we'll access your Xiaomi Account information to sync your plays, favorites, downloads, and sharing history across your devices.

1.2 Personal information you may choose whether to authorize us to collect and use

1.2.1 In order to provide additional features to make your Mi Music experience more enjoyable, the following additional features may collect and use your personal information. If you do not provide this personal information, you can still use the Mi Music platform, but you may not be able to access higher-quality music services. The additional features include:

A. VIP value-added services: You may enjoy VIP value-added services after paying a membership fee. When you make such a purchase, we will collect your Xiaomi Account information to create an order and provide you with value-added services.

B. Commenting and liking: When you comment or like a comment on a song, playlist, or video, we will collect your comment or like information for display.

C. Sync with the cloud: When you turn on Sync with the cloud, your song files, favorite playlists, and custom playlists will be automatically synced to the cloud. You can also choose to manually back up your music files. During this process, we will collect your Xiaomi Account information, song files, playlist information, playback records, or custom playlist information to save your music files and to restore your data when necessary. We also collect the song information that you specify when you back up manually.

1.2.2 Personalized recommendations

We will use algorithms to collect relevant data in order to personalize song or playlist recommendations, or to show you songs you may want to find when you search. For these purposes, we may collect information such as your Xiaomi Account information, OAID, device information, system version information, music playback, downloads, favorites, sharing records, app feature usage, and usage time.

To show ads that are tailored to your interests, we collect information such as a device identifier (IMEI/OADI/AAID/Android ID/SN), Xiaomi Account, app and system version number, and user ad clicks.

We may combine data we collect across services and from your different devices to deliver a consistent cross-device experience and to personalize our content, services, and recommendations. You may opt out at any time by turning off Recommendations in the app settings by going to General settings > Other. For detailed information, refer to "Your rights" below.

1.2.3 Additional features based on device permissions

In order to improve your experience using Mi Music, we may collect and use your personal information when providing you with the following additional features. If you choose not to provide this information, it will not affect your use of the basic services of our platform, but you may not be able to use additional features based on the personal information. The additional features include:

A. Features based on recording permissions

Grant recording permissions to use the Recognize songs feature.

B. Features based on location access

Grant location access to get recommendations of broadcasters and anchors in your area when using the radio section.

C. Features based on floating window permissions

Grant floating window permissions to be able to display Home screen lyrics while playing music.

You can restrict the aforementioned permissions and stop using the corresponding features at any time. For detailed information, refer to "Your rights" below. If you restrict these permissions, you may no longer be able to access features based on the permissions, but your use of other app features will not be affected.

1.3 You are fully informed that we may collect and use personal information without your consent if:

1.3.1 The personal information is vital to national security and defense;

1.3.2 The personal information is vital to public safety, public health, and major public interests;

1.3.3 The personal information is related to criminal investigations, prosecutions, trials, or execution of judgments;

1.3.4 The personal information is essential for protecting major legitimate rights (including life and property) and interests of the personal information subject or other people, but it is hard to obtain the subject's consent;

1.3.5 The personal information collected is made public by the subject at their own discretion;

1.3.6 The personal information is collected from public sources, such as news reports or government announcements;

1.3.7 The personal information is necessary for us to sign the contract as required by you;

1.3.8 The personal information is necessary to maintain the safe and steady operation of products and/or services provided, such as for discovering and handling faults of products and/or services;

1.3.9 The personal information is required for legal news releases; and

1.3.10 The personal information is de-identified in the results of statistical or academic research based on public interest.

1.4 Non-personally identifiable information

We may also collect other types of information that do not identify a specific individual (and which may not be defined as personal information). Such information may include (a) statistical data generated when you use a specific service, such as music playback and download records, video playback records, etc. (b) network monitoring data, such as playback error times, push notification feedback, etc., and (c) device information, such as device model, device name, language, region, and Second space data. The purpose of such collection is to improve the services we provide to you. The type and amount of information collected depends on how you use our products and/or services.

We collect information such as unique device identifier, device model, and system version number when you use our website or mobile apps. This information is aggregated and used to help us provide more useful information to our customers and to understand which parts of our websites, products, and services they are most interested in. In its aggregated form, data is not personal information and cannot be used to identify you. However, if we combine non-personally identifiable information with personal information, such combined information will be treated as personal information for as long as it remains combined.

2. Sharing your personal information with third-party service providers

Part of the services in Mi Music are provided by third-party service providers. For this reason, we need to provide some of your personal information to our partners, related parties, and third-party service providers in order to provide the services that you have requested. If we share your personal information with such third parties, we will take appropriate measures to ensure the security of the processing of your personal information, including but not limited to the encryption of your personal information. We will reasonably examine the data security environment of the companies and organizations with which we share personal information and sign data processing agreements with them; we will require third parties to take sufficient measures to protect your information and strictly abide by the relevant laws and regulations as well as regulatory requirements.

3. Retention policy

We retain personal information for the period necessary for the purpose of the information collection described in this Privacy Policy or as required by applicable laws. We will cease to retain and delete or anonymize personal information once the purpose of collection is fulfilled, or after we confirm your request for erasure, or after we terminate the operation of the corresponding product or service. An exception to this is personal information that we are processing for public interest, scientific, historical research, or statistical purposes. We will continue to retain this type of information for longer than its standard retention period, where permitted based on applicable laws, even if further data processing is not related to the original purpose of collection.

In order to meet relevant public security organs' internet security supervision and inspection requirements, users' online log information will be stored on our servers for one year.

Your information will be stored within the territory of the People's Republic of China.

4. Your rights

4.1 Controlling settings

We recognize that privacy concerns differ from person to person. Therefore, we provide examples of ways Mi Music allows you to restrict the collection, use, disclosure, or processing of your personal information and control your privacy settings:

  • You can turn off personalized content and ad recommendations in the app settings in General Settings > Other. Please note that even after turning off these features, you will still receive recommendations and push notifications, but they will not be based on your personal preferences;

  • You can view and manage permissions in More > General settings > Other > Permissions details.

  • View or delete your playback records, or remove playlists from your favorites;

  • Sign in or out of the Xiaomi Account.

If you have previously agreed to us using your personal information for the aforementioned purposes, you may change your mind at any time by writing or contacting us on https://privacy.mi.com/support.

4.2 Your rights to your personal information

Depending on applicable laws and regulations, you may have the right to access, rectification, erasure (and certain other rights) in relation to personal information that we hold about you (hereinafter referred to as "the request").

You may also access and update the details relating to the personal information in your Xiaomi Account at https://account.xiaomi.com or by signing into your account on your device. For additional information, please write to us or contact us via https://privacy.mi.com/support.

The request should meet the requirements of applicable laws and the following conditions:

  • The request is submitted through Xiaomi's exclusive request channel detailed above and for the protection of your information security, your request should be in writing (unless the local law explicitly recognizes the oral request);

  • You provide sufficient information to enable Xiaomi to verify your identity and ensure that you are the data subject or legally authorized to act on the data subject's behalf.

  • Once we obtain sufficient information to confirm that your request can be processed, we shall proceed to respond to your request within any timeframe set out under your applicable data protection laws. In detail:

  • Based on the requirements of applicable laws, a copy of your personal data collected and processed by us will be provided to you upon your request free of charge. For any extra requests for relevant information, we may charge a reasonable fee based on actual administrative costs according to and if permitted by the applicable laws.

  • If any information we are holding on you is incorrect or incomplete, you are entitled to have your personal information corrected or completed based on the purpose of use.

  • Based on the requirements of applicable laws, you may have the right to request the deletion or removal of your personal information. We shall consider the grounds regarding your erasure request and take reasonable steps, including technical measures. Please note that we may not be able to immediately remove the information from the backup system due to applicable legal and/or technological limitations. If this is the case, we will securely store your personal information and isolate it from any further processing until the backup can be deleted or be made anonymous.

We have the right to refuse to process requests that are not meaningful, manifestly unfounded or excessive, requests that damage others' right to privacy, extremely unrealistic requests, and requests that require disproportionate technical work, as well as requests not required under local law, regarding information that has been made public, and regarding information given under confidential conditions. If we believe that certain aspects of the request to delete or access the information may result in our inability to legally use the information for the aforementioned anti-fraud and security purposes, the request may also be rejected.

4.3 Withdrawal of consent

  • You may withdraw your consent previously provided to us for a particular purpose by submitting a request, including collecting, using, and/or disclosing your personal information in our possession or control. We will process your request within a reasonable time from when the request was made, and thereafter not collect, use and/or disclose your personal information as per your request.

  • Please note that your withdrawal of consent may result in certain legal consequences. Additionally, you may not be able to continue receiving the full benefit of Xiaomi's products and services, depending on how much authority you grant us to process your information. The withdrawal of your consent or authorization will not affect the validity of our processing carried out upon your authorization up until the point of withdrawal.

4.4 Canceling a service or account

If you want to opt out of a specific product or service, you can open the app, tap Profile, then tap the settings icon ("≡") in the upper right corner. From there, tap General Settings > Other > Cancel services to complete the cancellation of Mi Music services. This will not affect your use of other Xiaomi products.

If you wish to cancel the Xiaomi Account, please note that the cancellation will prevent you from using the full range of Xiaomi products and services. To protect your or others' legitimate rights and interests, we will judge whether or not to support your request for cancellation based on your use of various Xiaomi products and services.

5. Third-party websites and services

Our Privacy Policy does not apply to products or services offered by third parties. Mi Music may include third-party products or services. Some will be provided in the form of links to third-party websites, and some will be accessible in the form of SDKs or APIs. These may include music playback, radio playback, ringtones and other types of services. Your information may also be collected when you use these products or services. For this reason, we strongly suggest that you spend time reading third party service providers' privacy policies just like you read ours. We are not responsible for and cannot control how third parties use personal information which they collect from you. Our Privacy Policy does not apply to other sites linked from our services.
